Terms and Conditions Definitions
Owner: Bouncing Castles aka PonyCycle Party Hire Chch
Hirer: The person hiring/renting the equipment from the owner.
Equipment: The PonyCycles and accessories hired out by the owner to the hirer.
Contract: The agreement between the owner and the hirer for the supply of equipment at a negotiated price, within a defined hired period as bound by the terms and conditions. The hirer acknowledges the agreement becomes binding upon issuing an order either verbal or written requesting the owner to provide equipment and/or services to the hirer.
Payment: The hirer agrees to pay the owner's hire charge and any other charge, including charges for damage and repairs, loss that may be incurred and paid by the owner. These charges will be paid in full by the hirer to the owner prior to the owner releasing the equipment to the hirer. Subsequent charges arising from loss, damage, repairs, and other expenses are to be paid immediately upon receipt of a tax invoice.
Cancellation Fee: 50% if cancelled within the week prior to the function date unless due to wet weather.
Hirer's Obligations: The hirer will be responsible for the equipment hired from the time of its delivery until collection by or return to the owner. The hirer upon installation, delivery, or collection of the equipment immediately examines the equipment to satisfy itself to its condition and suitability for the purpose for which it requires the equipment. The Hirer will assume the risk and indemnify and hold the owner harmless from against any and all property damage and personal injury resulting from the use of the equipment. The Hirer will be responsible for all surface preparations and repairs. The Hirer will use the equipment in a proper, safe manner and only for the purpose and capacity for which it was designed.
1. DELIVERY: The hirer to provide clear access to the area where the equipment is going to be set up before and after your event. The hirer to secure all dogs before setup. The hirer to sweep and clear hard surface that PonyCycles will be ridden on of anything that may cause damage to the wheels e.g. Gravel, Sticks & Rubbish.
2. OPERATION:
The Hirer will provide a person over 18 years who shall supervise the use of equipment at all times in particular, the Hirer shall ensure:
A. That he/she has a continuous clear and unobstructed view of the equipment and the children thereon;
B. That not to allow overcrowding on the PonyCycles. Only 1 Persons are allowed on one at any one time.
C. That not to allow any persons that exceed the Weight limit on any one of the 3 Sizes of PonyCycles.
Small – 30kg, Medium - 45kg, Large - 90kg
F. That PonyCycles are ridden on suitable flat surfaces only like Concrete Driveways, Asphalt and Wooden floors. They must NOT be ridden on gravel, grass, sand or dirt or any other uneven surface.
G. No eating, drinking or chewing gum while on the PonyCycle to avoid damage and staining of Materials.
I. No flammables near the PonyCyles. This includes smoking and Barbeques.
J. No riding into another PonyCycle or object causing damage. No fighting, pushing or behaviour that could cause injury.
K. That the PonyCycle must not be operated or left in the Rain. In the event of rain, the PonyCycles must be stored under shelter.
L. In the event that the Ponycycle stops working as it should, please ensure the rider gets off the PonyCycle immediately and contact the Hirer.
M. PonyCycles do not go backwards and must not be forced or dragged backwards or sideways they go in forward motion only and to be turned via the handles on head.
N. Do not use foot pedals as step to climb onto PonyCycle. Rider must lift leg up and over ponyCycle seat to get on.
